(Title Insurance)?

Mechanic's Lien?

Buying a Home Privately in the US? Beware of a Hidden Time Bomb

US Real Estate 101 · Title & Closing

You can skip hiring an agent, but never skip escrow and the title company. A "private deal" that seems convenient can leave you holding a time bomb.

Key Takeaways

  • Escrow protects the money: funds go through a neutral third party, not directly to the other side.
  • The title company checks for debts and liens during each owner's tenure and issues title insurance.
  • If a home cannot get title insurance, do not buy it, no matter how cheap.
  • Common risks include tax liens, court judgments, and mechanic's liens, which are common in California.
  • A gap in the title history that was never searched or insured can make the home hard to insure and sell later.

1What Escrow and the Title Company Do

  • Escrow: protects funds. The buyer's money is held by a neutral third party and released only when contract conditions are met.
  • Title company: protects ownership. It searches for liens and other claims, and once clear, issues title insurance that covers covered title defects later.

Neither step should be skipped, even between friends or relatives.

2Every Owner Holds Just One Chapter

A famous watch ad says you never truly own it; you merely look after it for the next generation. That fits homes even better. A house built in 2000 might be owned by one person for 10 years, then another for 10, and so on — each owner holds only one chapter.

At each sale, the title company checks whether problems arose during the seller's ownership: a federal tax lien, a lawsuit judgment, or a mechanic's lien — common in California — such as when an owner withholds part of a roofer's payment over a dispute and the contractor records a lien.

If a home cannot get title insurance, do not buy it, no matter how cheap.

3What Happens If You Skip the Title Search

Suppose a seller says, "We trust each other; I will sign a grant deed and you wire me the money." The buyer has no idea what happened during the seller's ten years of ownership. Any unresolved liens may follow the property to the new owner.

It gets worse later. When that buyer tries to sell, the next buyer orders a title search and finds an uninsured gap. Insurers may decline or insure only from the current owner forward. Few buyers will accept an unknown history, so the value drops sharply. What looked like a bargain turns out to be a time bomb.

4Owners Often Do Not Know

Often sellers are not hiding anything; they simply do not know a lien exists. We have seen deals reach escrow after extensive marketing, only for the title search to reveal a small mechanic's lien. The buyer backed out and the deal fell apart.

No matter how well the parties know each other, follow the standard escrow and title process so the title company can confirm the property is "free and clear" and issue title insurance. It protects both sides.

FAQ

Q:What is title insurance?

A policy issued after the title company searches a property's history; it covers losses from covered title defects, such as undiscovered liens.

Q:Can friends or relatives skip escrow?

Technically yes, but it is not recommended. Standard escrow and title processes protect funds and confirm clear title for both sides.

Q:What is a mechanic's lien?

A lien a contractor or worker can record on a property when not paid in full. It must be resolved before a clean sale.
