Q:FAIR Plan

Homeowners Insurance After the LA Fires: Separating Myths from Facts

Insurance · After the Fires

After a disaster, more information often means more anxiety. In this episode we take the most widely shared claims online and ask an insurance broker to address each one: which are misunderstandings, and which mean you should review your own policy today.

Key Takeaways

  • Insurers cannot cancel a policy because a fire is coming. California requires advance written notice of non-renewal (generally at least 75 days), and after major disasters a one-year non-renewal moratorium applies in affected ZIP codes.
  • High-value homes in wildfire zones often start with the California FAIR Plan (dwelling limit about $3 million) plus excess layers. Many owners chose not to buy more coverage rather than being unable to.
  • Insurance pays to rebuild the structure (labor and materials), not the market value including land. Post-fire bargain land is less likely than many expect.
  • If you move a home into a trust or LLC, tell your insurer and add the entity to the policy, or claim payments and liability coverage can be affected.

1Myth 1: Insurers Canceled Policies Right Before the Fires

Not true. California has strict procedures for non-renewal, including advance written notice (generally at least 75 days). There is no way to cancel a policy the day before a fire. After major disasters, the California Department of Insurance also issues a one-year moratorium on non-renewals in affected and adjacent ZIP codes.

Stories of homeowners who lost a home without insurance usually involve premiums they decided were too high, an assumption that it would not happen to them, or a missed non-renewal notice.

2Myth 2: Luxury Homes Cannot Get Full Coverage

Many luxury homes are in the hills for privacy and views, which also puts them in high wildfire-risk areas. Many carriers will not write these homes, so owners start with the California FAIR Plan. The FAIR Plan dwelling limit is about $3 million, and high-end rebuild costs often exceed that.

Excess and difference-in-conditions layers above the FAIR Plan do exist, but they are not cheap. Many owners stop at the first layer after seeing the price. They chose not to buy more, rather than being unable to.

It is not that people cannot buy enough coverage. Many choose not to.

3Myth 3: Insurers Will Go Bankrupt Paying These Claims

Insurers use reinsurance, and large claims are not paid in one lump sum by a single company. Rebuilding payments are usually staged like a construction loan: foundation, framing, and completion.

The California FAIR Plan is not taxpayer-funded insurance. It is a pool funded by insurers that do business in California. Shortly after this video, in February 2025, California regulators approved a $1 billion assessment on member insurers to help pay FAIR Plan claims, which shows the industry-shared design in action.

4Bargain Land After a Fire? Understand What Is Paid

Homeowners insurance pays the cost to rebuild the house itself, mainly labor and materials. It does not cover land value. In scenic high-end neighborhoods, land is often a large share of market value, so insurance payouts are usually far below the original purchase price.

That means owners rarely sell valuable land cheaply. If you want to buy land in a burn area, expect to negotiate around fair market land value, not a fire discount.

5Homes Held in a Trust or LLC: Keep the Policy in Sync

After moving a property into a family trust or LLC, notify your insurer and add the trust or company as an insured. This usually takes minutes and costs little or nothing.

A homeowners policy covers both property and liability. Property claims are generally not denied over title, but the named insured can affect who the claim check is made out to. On the liability side, if a trust or LLC not listed on the policy is sued, defense and coverage may not apply. Please consult your insurance broker and attorney.

6Common Policy Questions

  • Can I over-insure to get a bigger payout? No. Rebuild cost is calculated from construction details. Over-insuring only raises premiums, while under-insuring can reduce what you receive.
  • Are evacuation hotel and meal costs covered? Most homeowners policies include Additional Living Expenses (Loss of Use), covering reasonable extra costs while the home is unlivable. The goal is to keep your normal standard of living, not to fund a vacation.
  • Does umbrella insurance cover my house? No. Umbrella is liability coverage for lawsuits over injury or damage to others. It does not increase property coverage.

When choosing an insurer, look at its AM Best rating, financial size, how long it has operated in California, and its claims record, not just the lowest quote.

FAQ

Q:What should I do if I get a non-renewal notice?

Contact a broker right away to compare other carriers or a FAIR Plan plus excess option so coverage does not lapse. If your home is in an affected ZIP code, check whether the moratorium applies.

Q:Is the FAIR Plan government insurance?

No. It is an insurer-funded plan of last resort with fairly basic coverage, usually paired with a supplemental policy.

Q:My home is held in a trust. What should I do?

Ask your insurer to add the trust as an insured and confirm liability coverage. Consult your broker and estate planning attorney for specifics.
