Escrow?
(Remove Contingency)?

A Home That Took Five Escrows to Close: A True Selling Story
This video was published on March 8, 2026. Figures, prices, and policies reflect that date.
US Real Estate 101 · True Transactions
Nothing was wrong with the home and the price was reasonable, yet it went into escrow five times before selling. Nearly every problem in this deal is a pitfall buyers and sellers can face.
Key Takeaways
- California uses escrow: opening escrow starts the transaction, with the buyer depositing funds and the seller providing disclosures.
- Condo financing may require both borrower and project review, including insurance and repair issues. Requirements vary; this alone does not establish lower appreciation than detached homes.
- Repairs, contingency removal and cancellation rights depend on the signed contract and written agreements. Agreeing to repairs does not automatically remove a contingency or create a cancellation right.
- A home that keeps returning to market raises buyer suspicion, so the listing agent must explain each cancellation clearly.
- There is no home that will not sell, only a price that will not sell; once the price is right, offers come.
1Escrows 1 and 2: The Problem Was the Community, Not the Home
The condo, in Irvine's 92603 with excellent schools, listed in April 2025 at about $1.28 million — just as the Irvine market began to cool.
First escrow: the buyer's lender said the HOA master policy deductible was too high for its guidelines. The team got the HOA to buy a supplemental policy reducing the deductible, but the process took time; the buyer would not wait or switch lenders and withdrew.
Second escrow: another financed buyer came in, but the community pool was under repair, delaying the condo approval report. The buyer could not wait and withdrew.
The lesson: condos depend on many factors beyond your own unit. The community's insurance and shared facilities affect financing and value.
2Escrow 3: A Buyer Who Would Not Remove Contingencies
After inspection, the third buyer submitted a long repair list; the seller demonstrated in person that several items worked fine. The seller still agreed to other repairs, such as an AC condenser rusted by sprinklers.
In this account, the parties disagreed over repair completion and contingency-removal timing; the seller sought cancellation and signatures were delayed. This is not a universal rule requiring removal upon a repair promise. Review the actual agreement, remaining conditions, deadlines and notices. This update has not reviewed the complete file or determined the legal validity of that cancellation.
The teammate representing the buyer, though on the same team as the listing agent, still advocated for the buyer. The team's rule: each agent represents their own client.
We do not fear clients who do not know; we fear clients who pretend to know and ignore professional advice.
3Escrow 4: A 1031 Buyer Backs Out
Months later, the seller reduced the price to about $1.2 million. The fourth buyer was a 1031 exchange investor under time pressure, which seemed solid.
On inspection morning, the garage door belt snapped. Rather than alarm the exhausted seller, the team had an assistant drop everything and get it repaired within two hours, and the inspection went smoothly. But just before contingency removal, the buyer received an unexpected tax bill and could no longer buy, canceling again.
4Escrow 5: The Right Price, Finally Closed
After four returns to market, buyers naturally suspected problems. The team prepared a written explanation of each cancellation for every inquiring agent and kept marketing.
The price was eventually adjusted to about $1.18 million, reflecting true market value at the time, and still drew two or three offers. The team chose the most reliable one, warned both sides of potential issues in advance, and the fifth escrow finally closed.
5Lessons From This Deal
- Selling a condo: before listing, understand the HOA's insurance terms, deductible, and facility repair plans, and prepare the documents lenders will need.
- Accepting offers: verify the buyer's lender and qualifications and assess the deal's stability.
- Repair negotiations: document repair scope, timing, verification and contingency arrangements, and follow the signed agreements; a negotiation preference is not a universal legal requirement.
- Repeated returns to market: prepare a clear explanation and adjust promptly to a realistic price.
- Reading buyers: visitors who point out flaws at open houses are often the most interested.
Agents on both sides act as buffers; if buyers and sellers dealt directly, many deals would struggle to close. For contract and legal questions, consult an attorney.
FAQ
Q:What is escrow?
A neutral arrangement for handling funds and documents under escrow instructions. Opening escrow is not closing and does not waive contract conditions.
Q:Why do condo loans run into more problems?
Some programs require project review; insurance, finances, critical repairs or litigation may affect eligibility. Scope, waivers and remedies depend on the loan and lender; switching lenders is not a guaranteed solution.
Q:What does removing contingencies mean?
Removing a contingency affects cancellation rights under that condition; C.A.R. agreements call for signed written removal. It neither guarantees closing nor automatically decides deposit ownership; review the contract and remaining rights.
