Buying Strategy · Seller's Market
Few sellers and many buyers make a seller's market. When prices are similar, what makes your offer win?
Key Takeaways
- California's standard resale contract protects buyers, who can cancel during contingency periods and recover the deposit, leaving sellers exposed.
- So sellers care about how fast you close and how many days until you remove contingencies.
- Once a seller accepts an offer, they must sell to that buyer under the contract; other higher offers can only be backup offers.
- Knowing the seller's special needs, such as a rent-back or included furniture, helps you write a stronger offer.
1What Sellers Care About Most
When prices are close, sellers look first at speed: how quickly you can close. Next is how soon you will remove contingencies.
In California, buyers decide whether to proceed after inspections, seller disclosures (for example, deaths on the property within three years, flooding, fires, or other major issues), and HOA documents. Until then, buyers can cancel under the contract and recover their deposit, so sellers have no certainty. The buyer in this video offered a strong price and committed to removing contingencies quickly if the inspection showed no major issues, which is exactly what sellers value.
2Why Sellers Choose Carefully
California's standard purchase agreement protects buyers. Once a seller accepts an offer, they must sell to that buyer per the contract. Even if someone later offers more with shorter contingencies, that offer can only be a backup, effective only if the first buyer cancels.
So sellers gauge buyer motivation: is this buyer serious, or tossing out a number to see what happens? The latter is rarely accepted.
Beyond price, certainty is your strongest card.
3Learn the Seller's Special Needs
Some sellers need to rent back after closing while they find their next home; others want to leave furniture or certain items. Buyer agents who learn these needs early can address them in the offer and improve the odds.
4Common Findings at Inspection
A professional inspector found no major issues here, only minor items such as a slightly leaking valve and a clogged gas valve on an outdoor fireplace that needs cleaning, likely inexpensive. Inspectors also test the spa, heating and circulation, and the barbecue.
The inspection report drives the buyer's decision to remove contingencies or request repairs or credits. Buyers should attend if possible and hear the inspector's explanations firsthand.
FAQ
Q:What is the risk of shortening contingencies?
Less time for inspections, appraisal, and loan approval. Make sure you can complete them within the period before committing.
Q:What is a backup offer?
After a seller accepts an offer, other buyers can wait in line; a backup becomes active only if the first deal cancels.
Q:How is a seller rent-back arranged?
Usually through a contract addendum setting the term, rent, and deposit. Have your agent help draft it and consult professionals.
